How IMEs Are Conducted

Before conducting an IME, the physician receives the evaluee’s medical records (past and present), accident and injury reports, filings with the applicable court, witness statements, depositions, and reports of other experts. From these the expert physician formulates relevant questions to be asked in the IME.

The psychiatric IME typically includes a detailed clinical interview addressing personal background, education, employment history, social history, medical and surgical history, psychiatric history, medication use, legal history, and the events giving rise to the litigation. The evaluation may also include a mental status examination, symptom inventories, diagnostic assessment, and, when clinically relevant, a directed physical or neurological examination.

After the examination and record review are complete, the forensic psychiatrist prepares a written report addressing the referral questions posed by the retaining attorney. The report connects the records, examination findings, diagnoses, and expert opinions in a format intended to assist counsel, the court, and other legal decision makers.
